Hi, and welcome. We're OtterS ("OtterS," "we," "us," or "our") - a student-led media collective in Montréal, Québec, Canada (Collectif OttersTogether), currently in the process of registering as a non-profit. We know a terms of service page isn't anyone's idea of a good read, so we've kept ours as plain and honest as we can. These Terms of Service ("Terms") cover your use of otterstogether.org (the "Site"), our free media services, and any donation you choose to make. By using the Site, reaching out, applying to join, or donating, you're agreeing to them. It's worth reading them alongside our Privacy Policy.

Section 01

Accepting These Terms

By accessing or using this Site, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site or our services. If you are using the Site on behalf of an organization, you confirm that you are authorized to accept these Terms on its behalf.

Who We Are & What We Offer

OtterS is a passion-driven collective of creative students that provides free media services - photography, videography, storytelling, and related content - to fundraiser-first social impact projects, where raising funds, awareness, or support for a meaningful cause is the central reason the event exists.

Because our work is offered free of charge and depends on the availability of our student volunteers, our services are provided on a goodwill basis. Accepting a project, the scope of any deliverables, and timelines are agreed on a case-by-case basis and are not guaranteed unless confirmed in writing. We reserve the right to decline or discontinue any collaboration at our discretion.

Section 03

Working Together

When we collaborate on a project, both sides agree to act in good faith. You agree to:

  • Provide accurate information about your organization, event, and the cause being supported.
  • Secure any permissions, releases, or permits required for us to film or photograph at your event (including consent of attendees where required by law).
  • Communicate clearly and reasonably about expectations, scheduling, and access.

Any specific deliverables, timelines, or arrangements discussed by email or message are part of our understanding with you but do not create a paid commercial contract.

Section 04

Donations Through Stripe

Donations made through the Site are voluntary gifts that help us cover equipment, software, and project costs so we can keep our services free. All payments are processed securely by Stripe, Inc. - OtterS never receives, stores, or has access to your full payment card or banking details. By donating, you also agree to Stripe's terms.

  • Donations are made in Canadian dollars (CAD) unless otherwise stated at checkout.
  • You confirm that any payment method you use belongs to you and that you are authorized to use it.
  • As we are still completing our non-profit registration, donations are not currently issued official charitable tax receipts and should not be treated as tax-deductible unless we expressly confirm otherwise in writing.
  • Donations are not a purchase - no goods or services are exchanged in return for a donation.

Refunds & Cancellations

Because donations are voluntary gifts, they are generally non-refundable. That said, we never want you to be out of pocket for an honest mistake. If you donated by error, were charged a duplicate amount, or believe a charge was unauthorized, please contact us within 30 days of the transaction:

Please include the date of the donation, the amount, and the name and email used at checkout. We will review every request in good faith and, where a refund is warranted, process it back to your original payment method through Stripe (typically within 5-10 business days, subject to your bank).

Approved refunds are returned to the original payment method only. We are unable to refund a donation to a different card or account.

Section 06

Intellectual Property

Our content. All media we create - photographs, videos, edits, music, graphics, and written content - together with the OtterS name, logo, and the design and code of this Site, are the intellectual property of OtterS (Collectif OttersTogether) and are protected by copyright and other laws. We retain ownership of the work we produce unless we agree otherwise in writing.

What partners receive. When we create media for a charity or fundraiser project, we grant that organization a non-exclusive, royalty-free licence to use the finished deliverables for their own promotional and fundraising purposes, with credit to OtterS where reasonable. Resale, sublicensing, or use of the raw footage is not permitted without our written consent.

Portfolio & storytelling. As part of building our reputation, OtterS may showcase the work we create - and tell the story of the causes we support - across our website, social media, and portfolio, unless we have agreed otherwise with you in advance.

Your use of the Site. You may not copy, reproduce, scrape, or redistribute content from this Site for commercial purposes without our permission. Third-party logos, brand names, and materials belonging to the organizations we work with remain the property of their respective owners.

Section 07

Acceptable Use

When using the Site or contacting us, you agree not to:

  • Submit false, misleading, or fraudulent information through any form, including donations.
  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to, disrupt, or interfere with the Site, its servers, or its security features.
  • Upload or transmit malware, or use automated tools to harvest data from the Site.

Third-Party Services & Links

The Site relies on trusted third-party providers - including Stripe (donation processing), Google (form handling via Apps Script and Sheets), and Vercel (hosting). Your use of those services may also be governed by their own terms. The Site may also link to external platforms such as Instagram, LinkedIn, and Facebook. We are not responsible for the content, policies, or practices of third-party sites and services.

Disclaimers

We pour a lot of care into our work, but we have to be honest about what we can promise. The Site and our services are offered "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent the law allows. We'll always give a project our best, but we can't promise the Site will never go down or hit a glitch, or that our work will lead to any particular outcome, like more donations, reach, or visibility. What we can promise is that we'll show up and do the work with heart.

Section 10

Limitation of Liability

To the fullest extent the law allows, OtterS, along with our members and volunteers, can't be held responsible for any indirect, incidental, or consequential damages that come out of your use of the Site, our free services, or any donation. And nothing here takes away the rights you already have under the consumer protection and other mandatory laws of Québec and Canada that can't be signed away.

Section 11

Governing Law

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts located in the judicial district of Montréal, Québec.

Section 12

Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, services, or applicable law. Any changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
